Got this PCN through in the post today.

I'm not the owner of the vehicle .

Would appreciate someones thoughts on this .

If anyone could help with my response to the information parking eye have logged in response to my appeal i would really appreciate it .

They have posted the contract to operate at holiday inn, the signage layout , pictures of the signage , correspondance with the vehicle owner and a copy of the hire agreement .

All i can think to do is to re-iterate that i was not sent the hire agreement along with the notice to hirer or at any other time amd that this means they failed to operate under the pofa legislation .

I think they are trying to get his overlooked by popla by uploading the document to the appeal .

Any help or suggestions would be gratefully received .

You comment that in the NTH they state that they have been provided with the hire agreement, a statement completely unnecessary if they had supplied the same to you. And can they sow that it was submitted to you.

Thanks ostell , i will put something together and post on here if you could citique i would appreciate it .

I have attached the case history below and i'm pretty sure it does not show the hire agreement being supplied to me . It wasn't but i do not trust these people

They also mention the point about the headlights not being on in the vehicle so signs do not need to be illuminated. I was going to say something on the lines that this was a general assumption and obviously didn't pertain to the case involving the vehicle that i was the hirer/keeper of .

However, strangely they mention that i stated something about the parking charge is unfair or unreasonable , this is not true and i did not state this in my appeal .

So i thought i could mention this if it is worth it .

Dear POPLA Assessor,


Having now reviewed the case file that has been uploaded to the appeal by Parking Eye, i would like to comment in response .

In the Notice to hirer i received from parking eye they state they have been provided with the hire agreement. I find this statement completely unnecessary if they had supplied a copy of this document to me .

Parking eye have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 by failing to supply the additional documents mandated by section 14 (2) (a) of the Act.

Section 14 (2) (a) mandates that I should have been sent copies of the original Notice to Keeper and the hire agreement along with the Notice to hirer and i would like to ask Parking Eye can they show that these documents were submitted to me .

Ostell , i am sayng can they show "me" that they supplied the hire agreement to "me". Knowing full well they cannot .

You suggested this in your previous post - below .

So, shall i just omit the part that says - " and i would like to ask Parking Eye can they show that these documents were submitted to me ."
