Just received debt collection letter for £584 for an offence which happened in Italy 2 years ago.
Hire car company sent me an email about 18months ago in Italian with a PDF of the offence and took money out of my account. I assumed that it was taken for the speeding fine. About 3 months after that the postman knocked at my door and had a signed for letter from Italy and I joked that it was probably for the speeding fine I'd paid and told him I didn't want it. He took it back to the depot to return to Italy I assume. Now I think that the original amount taken from my card was an admin fee and didn't pay the offence. As I have not been served a letter with the original offence am I liable for this? I assume there is a record of the letter being returned somehow. I assume the debt collection agency can only ask for the money and nothing else. Is it possible that this could end up in a county court (bailiffs being involved) where I couldn't prove that I hadn't received the letter? i assume it's pointless contacting the debt collectors to say I haven't received a letter from the Italian Authorities. Thanks for your help. |

Debt collectors letters are safe to ignore.
The Italian authorities could ask the CPS to collect the fine through your local magistrates' court, but as the money then gets paid to the local court and isn't remitted back to Italy, they never seem to bother. Thanks for that. So there is no way that the Debt Collectors can go to go court now that they own the debt?
Would it be worth me contacting them saying I have had no notification of this offence. i know they have no rigt to take me to court and willl not be paying it. Might it save further demands? Cheers |

My understanding is no, as they have no standing - theyve not suffered any damages. Also to prevail they wouldhave to show how you are somehow owing them some money - meaning presumably they would have to prove your liability for the alleged offence, etc.

I go to Italy every year and without fail a speeding offence letter and fine follows shortly after. I should have kept them all instead of throwing them away.
I am yet to pay one or be otherwise bothered by someone chasing the fine on my return to Italy and hiring a car. I know I have complied with the speed limits but acknowledge I may not have seen every one. I would be surprised if I had passed a speed camera and not noticed it. I think that there may be some form of standard letter that is sent to visitors in the hope that they pay. |

They apparently have average speed cameras on all the main motorways around Milan. You can usually tell because all the Italians slow down to 80-85, while the German and Swiss plated cars keep going at 100+ mph. They are everywhere now on the city to city roads but they are very obvious so I just put it on the cruise control and drive slow, and so far no speeding tickets from Italy despite driving over 1000 kms there. Almost certainly to late for them to do that now as it seems to have got past that stage. I don't think there is anything the OP needs to worry about now, except for receiving more begging letters. |
