Hello All,
First time poster. I received a PCN, code 27 Parked in a special enforcement area adjacent to a footpath, cycle track or verge lowered to meet the level of the carriageway. I believe the PCN to be invalid because : 1. it is nowhere written that it is special enforcement area, 2. My parking did not block any entrance and 3. car was parked correctly and did not parked where verge lowered to meet the carriageway. Somebody complained to the council that my car is blocking the entrance of their car but I'am sure it wasn't. I have uploaded 5 pictures taken from the council's website but whoever took the pictures did not do great job, it was raining and quite dark at that time. Please look at them and kindly advise. (which is behind the flats) and not at De Havilland road (which is in front of the flats) Dear Sir / Madam Ref PCN BT12953205 VRN LN08TKD It is alleged that I was parked in a special enforcement area adjacent to a footway, cycle track or verge lowered to meet the level of the carriageway. Location: os 212-222 flats Street: De Havilland road I was not. I was parked at Halfords Close.There is no parking place outside these flats (212-222) on De Havilland road. I also note that the CEO photos do not establish any contravention nor can they be matched to any location within the De Havilland Road. Given that the allegation cannot be substantiated, please confirm cancellation of the PCN. Kind regards |

It is actually the Halford close and not De Havilland road as mentioned in PCN. Well if the allegation is that you were parked illegally on De Havilland Road but your car wasn't on De Havilland road, then the alleged contravention did not occur. They have rejected the informal appeal, in-spite of wrong location and nothing on the photographs that shows contravention, Below is what they wrote to me NOTICE OF REJECTION OF INFORMAL CHALLENGEThank you for writing to us regarding the above Penalty Charge Notice (PCN).Your informal challenge has been considered by this office in accordance with the requirements of theTraffic Management Act 2004. After a careful consideration of the grounds you have made and all otherrelated circumstances we have decided not to cancel your PCN.The reason for the rejection may be summarised as follows:You were issued a PCN for parking against a stretch of lowered, sloping kerb. Kerbs are built like this toallow easy access across them. They exist at different locations for different reasons: to helppedestrians cross the road, especially people with prams or wheelchairs; to allow cars access togarages; and to allow cycles to cross from roads to cycle tracks.I have enclosed the photographs taken at the time the contravention occurred for your information. What shall I do now guys? I thought to ask you one last time. the images they have are shows nothing, still they have decided to not to cancel the PCN. Thank you all. |
