Hi I’ve been pointed in your direction hoping someone can offer advice my daughter has had the baliffs at her door she didn’t answer as it was at 6.45 in the morning they put a note under her door. so she rang them they told her it was for parking tickets in a council car park Rouen Rd in Norwich (it’s the 1st she knew of this) was dating from July 2018 Her ex was the main driver at the time as she only has provisional car is in her name as he couldn’t get finance . she told them this but they were not interested they told her as she was the owner of the car it’s her responsibility to pay and they would force entry into her property to get goods to the value of £800 in a panic as she has 2 young children she paid them half borrowed the money off a friend before speaking to me. I went mad with her told her she should of called the council and explained to them who was driving (He has lots of parking tickets did not give a **** where he parked ) she still has another 400 to pay which they want by June. Have you any advice as they have really frightened her

They are correct as in it doesn't matter who was driving. The registered keeper is liable.

Did she receive any previous correspondence in the post? Get her to check her V5C (logbook) and whether the address on it is correct.

She no longer owns the car as I now own it, as she could no longer afford the payments after they split up it she did have change of keeper letter from DVLA she’s had no correspondence whatsoever ever as she would of informed them of who the driver was like she has done with all other parking invoices she received because of him

So when you changed the keeper to you, was her address up to date before you sent it off?

There's a difference between private parking, where the one who sees the signs is liable, compared to council parking.

If it's on finance, the owner will be the car finance company I guess? I assume this gets us no where and she, who took out finance, is going to be liable.

This is about process now, not the original PCN or who copped it.
We need to see if we can get the process reset.

Process would have been original PCN.
Then Notice to Owner.
This sent to the Registered Keeper at address on Registration Document (V5c)
Then Charge Certificate, Then Order for Recovery, Then Bailiffs.
All to same address until bailiffs traced daughter.

So first step.
When the PCN was served and month or so after, what address was on the registration document ?
Was it correct for where she was living?
Did she move around this time?
Did she update V5c?
If so when ?

Can contact the Authority and ask for a PCN history, dates and addresses used for starters.
No point in arguing the case, just get information

You (daughter) also need to phone TEC (Traffic Enforcement Centre) which is the central court dealing with these and who can reset the system.

You will need forms TE9 and TE7 (download) https://www.gov.uk/government/collections/t...nt-centre-forms
But check with TEC the right ones.
And get address on the warrant that TEC have on record.

Do not fill in forms or send until you have all the information and dates as above.

Who owned the car at the time of the contravention.

i.e. paid for it, insured it, taxed, etc.

Is it possible the ex could have binned the post e.g. NTO? It seems he obviously failed to notify her of the PCNs etc.

He never informed her of the tickets he never has done only time she has knew about this is when baliffs turned up so had no paperwork whatsoever..any other tickets he has had she’s always received notice to keeper which she has then replied bk that it was him that was driving... he didn’t care where he parked even though she paid for a private parking space 200 yards from the flat he still parked it where ever . even the day they split up in jan this yr due to domestic abuse he managed to get 4 tickets within 24 hrs

She was the registered keep when this happened bk in July 2018

He did have access to her post box so maybe he did manage to get to it before she did

Yes her address has been on the v5c since she had the car she has been at this address for last 5 yrs he has had other parking notices before then and she always received NTK hence why she paid for the private parking place

Call the council and chase up how NTO and Charge Certificates were sent, what date and what address.

Is there an ongoing Police investigation? Get in touch with them about post going missing and keep the council informed.

I am the person who has had the bailiffs at my door I have never recieved any paperwork from the council and this was the 1st I knew he had parking tickets from the council I've never received any debt letters for it or anything

I was woken up Wednesday morning at 6.45 by baliffs and yes the debt was £709! I paid £393 of the debt and the rest has to be paid by June! I paid it because they threatened to knock my door down and take my things and I wasn't allowing that to happen with 2 young children!!

I have recently gone through domestic abuse and having told them this and explained everything they didn't care! I am not to blame for this debt my ex partner is!

How am I meant to prove it with no letters? But a letter saying removal notice?

I am not stupid to ignore parking tickets! I have put every single one into my exs name and I haven't heard anything since which was private ones but I never knew about this council one!
