Lewisham PCN not on vehicle

Hello,

I today received NtO for a parking offence which I didn't commit in the first place.
I stay at my girlfriends house regularly which has residents parking outside which starts at 9am on weekdays.
In April I stayed on a Sunday night and got up at 9 on monday to put a permit on the car. I got to the car bang on 9 (a little before if anything) and there was already a warden taking pictures of my car. I remonstrated with her that it was not yet 9 (although the time on her picture reads 9:02) and even so I had the permit which I showed her. She said that was okay and that she would ring the council and walked off. She didn't put a ticket on my car and the photos show no ticket nor can you see the window which I hung the permit on (the permit instructs you hang it on the inside of the window nearest the curb).

I thought all matters were done as I hadn't received the ticket until today when I got the notice to owner instructing me to pay £130.
Do I have means to appeal? I feel the pictures do not show me committing an offence nor do they show a ticket on the car.






Any help would be great!

You have had no replies as you need to show us a pic of the front and back of the PCN please. We always need to see the documents.

Hurry up with the PCN, but on the face of it they have shafted you, as the CEO should have put a PCN on your car. As you have the NTO, it is now a no-brainer to go to the adjudicators, as there are no additional costs.

However until we see the NtO we don't know if it is for your situation, or for another PCN on another date and place. Are your V5 details correct ? Postal PCNs are sent to the keeper and the address on the V5.

I'm pretty sure my V5 details are correct as this it what they use to send the NtO anyway isn't it?

OK, so you have the NtO, so you have to appeal this, and then, if they reject, (almost a certainty), you can then appeal at no additional cost to PATAS. Your appeal will centre on the time, assuming the restriction starts at 09.00.

What is happening is sheer council rapaciousness and needs stopping but don't hold your breath on the Government doing anything about it anytime soon. FWIW I think, you have a strong case. Keep us posted on what happens and we can review your appeal text.

I received a letter today informing me that they have accepted my appeal and cancelled the fine and the NtO. I didn't expect it to be this easy haha

Too right they should have done - and the lying mare of a CEO should have been disciplined for telling you she would 'phone them' then sneakily completing her PCN round the corner (presumably hoping you'd pay up and knowing she'd be long gone by the time you saw an NTO in the post).
