No thread on here as I was helping a work colleague directly.
Invoice from APCOA for not paying and displaying in a station car park, driver had overstayed the free pickup time while waiting for their spouse as the train was late. Despite being a station car park and a clear entry sign stating it was railway land there was no mention of byelaws on any sign or in the PCN. First appeal was based on PoFA non compliance (no attempt made at all, notice outside 14 day, plus it's not relevant land) and was rejected on the basis they "weren't using PoFA". POPLA appeal was doubled up, using PoFA as if it were a regular PCN and then effectively a second appeal in one in case APCOA tried to claim it was actually a penalty notice under byelaws and providing the appeals basis for that as well (outside 14 days, no mention of penalty before, keeper not within geographical limitations of the railway land). Just had the POPLA result that APCOA have decided not to contest the appeal, as such the appeal is upheld. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
