Hi all,
New here and hoping for some advice, or at any rate, some words of encouragement! I'll try and keep this brief... At the weekend I was stuck behind two cars on an NSL going on average 45-50 mph, who I sat behind as there were no safe places to overtake. There's a stretch of road, however, where it widens with a gentle incline and visibility is good. There's also a turning on the left and a sliproad/filter lane in the middle for those turning into this road from the opposite direction. This has hatched road markings on either end, bordered by a broken white line. I saw that the opposite side of the road was clear and decided that I could overtake the first car in front of me before the turning and then overtake the second further along the road if needed. However, on the first overtake, the driver of that car decided to speed up as I was alongside him. As I was now in the "filter lane", I sped up to pull back in on my side, but the car in front decided to put their brakes on! By now, cars were coming in the opposite direction and I was rapidly running out of hatched road. I did manage to get in front of both cars in the end, but it was hairy. No one flashed their lights or sounded their horn, but I'm sure my driving didn't look great. I'm now sat here waiting for an NIP to drop through the door and I feel sick with worry. I wish I'd never overtaken and had just remained patient. I have a clean license, have never been caught speeding, etc., but I've looked online and read about lots of instances of bans, £5k fines and prison sentences! Honestly, I could cry. Any advice if an NIP does appear, or is it just a waiting game? Thanks in advance! This post has been edited by CWSC: Mon, 14 Jan 2019 - 18:45 |

I doubt you'll hear anything, especially if the other car did sped up.
You won't be going to prison. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Any advice if an NIP does appear If a NIP were to arrive the only advice we would give is to name yourself as the driver within 28 days. -------------------- |

Thank you for your reply. Good to know prison is unlikely! This has shot my anxiety through the roof. I'll just never do anything like that again and drive sensibly.

What made you think prison or a £5k fine was on the cards?

Looking on the Internet usually results in me expecting the worst. Plus overtaking on or near a junction is a massive must not in the Highway Code, which I really should have remembered at the time.

I think you will find it is a "do not" which does not, of itself, have a specific piece of underlying legislation.

Ah, that's not too bad then.
Think I'll chalk this up to over thinking, over reacting and a sign to be more patient on the road. Thanks for your replies! |

Jeez, if 5k fines and jail happened for that sort of error of judgement, I'd have been serving life and bankrupt before I was 30.
Doubt you will hear anything. Treat it as a learning experience to apply for future overtaking. |
