HELLO CAN ANYONE HELP.
I WAS GIVEN A PARKING TICKET FOR PARKING IN A PARKING BAY-MARKED WITH BROKEN WHITE LINES. THERE IS RESTRICTED PARKING FOR AN HOUR.I CAM OUT OF THE SHOP AFTER =45 MINUTES AND HAD RECEIVED A TICKET FOR PARKING ON OR NEAR TO A BUS STOP.
I HAD NOT REALISED THERE WAS A BUS STOP AS THE AREA IS BIG ENOUGH FOR ABOUT 10 CARS AND THERE WERE CARS PARKED THERE ALREADY, AND I JUST PARKED IN A SPACE. THERE IS A POLE NEAR TO WHERE I PARKED BUT NO INDICATION AS THE SMALL TIMETABLE(METAL) WAS FACED AWAY FROM THE ROAD TOWARDS THE SHOPS. THERE IS A BUS NUMBER SIGN AT THE TOP OF THE POLE, BUT DRIVING UP I DID NOT NOTICE THIS. THERE ARE NO LINES ON THE ROAD TO SAY A BUS STOP IS THERE-WHEREAS LOOKING ROUND THE AREA AT OTHER BUS STOPS ,WHERE THERE ARE NO YELLOW LINES AT THE BUS STOP IT IS MARKED SO A DRIVER WOULD BE AWARE AND NOT PARK THERE.
MY ARGUMENT IS, APART FROM THE FACT THERE WAS NO INDICATION ON THE ROAD, HOW LONG IS A BUS? WHERE ARE YOU SUPPOSED TO PARK-THE BAYS ARE NOT MARKED, IT IS JUST A LONG PARKING BAY.HOW WOULD WE KNOW WHERE THE BUS STOPPED-BEFORE THE POLE, AFTER THE POLE??
WHEN I RETURNED TO MY CAR THERE WAS ANOTHER CAR PARKED NEXT TO ME WHO DID NOT RECEIVE A TICKET AND HAD BEEN PARKED THE SAME TIME AS ME.
SINCE THEN THE AREA HAS BEEN BLASTED AND RE-TARMACCED AS THE AREA WAS BEING PREPARED FOR RE-SURFACING-I TOOK SOME PHOTOS AT THE TIME OF THE TICKET ISSUE AND AFTERWARDS.
PLEASE COULD ANYONE GIVE ME SOME ADVICE AS I WANT TO FIGHT THE TICKET-AS I WAS NOT CAUSING AN OBSTRUCTION.
THANKYOU

Can i give a quick suggestion - please don't use a huge font and ALL CAPS, as it its hard to read.

The first thing is to scan/photo the PCN and post it here, along with the picture of the bus stop markings you took. If it is as you say, then it's most likely unenforcable.

It doesn't really matter what the markings are like now.

Those top markings don't look right to me. I'm sure someone'll be along soon to point out what's wrong with them.

hi just that the shop-keeper said that she thought the bus stop had been put there temporarily because of the road-works further up the road.

Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.

It's clearly not parked on a bus stop or stand though is it gang?

That's enough for a "contravention as stated did not occur" appeal, no?
