I have received the following letter from a German debt collector.

I don't remember receiving anything by post from them. I also dont remember giving the site my address, so how they found me I dont know

It is regarding a site which I tried to cancel by both email and through the site, but my cancellation was not accepted unless I write to them by post.

I dont remember contacting the credit card company regarding this. I didn't sign up to indefinite membership.

Have they got any jurisdiction in the UK? Presumably if they wanted to take me to court they'd have to come here.

I'm not paying it, but may phone them (witholding my number) depending on what others say.

Why didn't you write to them by post?

I doubt they will do anything for that sum, not least as they can easily inhibit access so have made no 'loss'.

Without looking into it in any depth, if they tried claiming from you in the UK I imagine that under the Consumer Right Act 2015 a term that requires you to send them a letter in the post would be deemed unfair.

That being said, I very much doubt they're going to engage English solicitors to recorder less than £80. It's not unheard of for companies sending out letters to pursue debts that they know they can't enforce, or can't cost-effectively enforce. Even if the response rate is 1%, it makes it worthwhile to send the letters. I would keep the letter but not take any action in response to it, the overwhelming likelihood is that they will write it off anyway.

Did you sign up initially by post? Didn't think so.

Some people think that I make them feel stupid. To be fair, they deserve most of the credit.

No I didn't sign up by post. To make matters more difficult, you couldn't try to cancel your membership between certain days before and after payment! Talk about making it difficult to cancel!

Yeah that would almost certainly amount to an unfair term.

I’ve received a text message from a firm of German lawyers Themis and ****

QUOTE
saying they are conducting a claim against me on behalf of interstate SA Proper authorisation is assured. You can settle your claim online at:……..

They go on to say that if I consider the claim unfounded we kindly ask you to submit your objection via email to ……..

I take it this firm is a bit like Gladstone in the UK.

So the question is do I respond to them or just leave it.

Considering that its outside their jurisdiction, unless the sue me in a British court, I cannot see how they have a leg to stand on.

Your advice would be very appreciated.
