Hi

I have today received a NIP. I've completed the Wizard and it told me that I should provide the information requested.

The NIP was received within the first 14 days. I am the RK and the Driver at the time of the alleged offence. The date of the alleged offence was 12/9/19 and the NIP is dated 19/9/19.

The alleged offence is listed as:-

'Speeding - exceed 30 miles per hour on restricted road - automatic camera device (Speed 35mph) (Contrary to Section 81(1) and 89(1) of the Road Traffic Regulation Act 1984 and Schedule 2 to the Road Traffic Offenders Act 1988).'

They have requested driver information and state that their allegation can be supported by photographic evidence in court from a device approved by the Home Office.

Under S.172 RTA 1988 they inform me that I must provide the information they ask for on the back of the form within 28 days.

They state that if I provide the information on time, 'YOU MAY' be able to take an educational course instead of paying a fine and having penalty points on your licence. Available for a limited time frame only.'

Please advise!! Thanks :-)

J

If I want to take the wrap for the American friend, just in case it was me and I can't be sure either way, your (plural) advice is that I should provide my details?

My advice is that if you take the rap knowing you weren’t driving you commit an offence of perverting the course of justice. You must name the actual, real driver.
