Hi folks,

My wife has received a PCN from ParkingEye for overstaying in the Robroyston retail park car park in Glasgow. On the day in question she went to meet someone for lunch. The max time for parking is 4 hours and she tried to leave after 90 minutes. On this particular day there was an accident on the only exit from the car park. My wife waited in a queue for 15 minutes and there was no sign of traffic moving and then the police and an ambulance turned up. She had to get back to work for a meeting so she had to leave the car and walk home. After work she walked back to the car park but by this time the car had been there for more than 6 hours.

My wife appealed and provided the newspaper report showing the road was closed for a period but, as expected, ParkingEye rejected the appeal. We then appealed to POPLA who also rejected the appeal.

Question is, would it be worthwhile challenging this in court or should we just take the hit? I’d argue that my wife fully intended to leave the car park in time but as she was prevented from doing so the owners of the car park where first to breach the conditions of the ‘contract’ as they didn’t provide a way to exit so we cannot be held to the condition of the contract but my wife doesn’t really want to take the risk of the fine and the court costs if we lose.

Also, anyone got an idea of what the court costs could be as I’m more up for the fight?

See if they take it to court. Paying is stupid.

They'll never take this to court.

Shame that anything was done. In Scotland there is no keeper liability as POFA does not apply and they don't know the driver
