Hi All,
I got a letter for overstaying about 30mins in a sports direct car park. I have a receipt for a few hundred quid to show how much I spent in the store. What letter can I send to ParkingEye? |

what's the shorter, more concise version of this appeal? You appeal properly... it's worth a lot of saved hassle, so do it properly. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

what's the shorter, more concise version of this appeal? You appeal properly... it's worth a lot of saved hassle, so do it properly. Thanks, but I'm not sure if I should use the whole letter or not. @thug states that they removed 1st part as NTK wasn't invoked in their case. Same with me, no NTK/POFA invoked in mine. The second section of letter deals with ownership of land/forming contract. A bit perplexed |

It’s a starting point, you edit it for your situation.
This is worth £100 or possibly more if they drag you to court (when it will take a lot more effort to defend) so it’s worth putting into some effort. It’s a starting point, you edit it for your situation. Thanks and apologies if I'm fishing for more support than I should. I'm just trying to understand my line of defence. This whole POFA/NTK technicality is clear as mud to me. I know that the letter was received after the 14th day (alleged contravention 28th September, date of issue Saturday 10th October, received 14th Oct). I know that the POFA act states that QUOTE (4)The notice must be given by— (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period. (5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended. (6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales. So clearly it's not met that condition and should fall down at that hurdle. What has thrown it for me is, as mentioned in previous OP comments on this thread, that the PPC didn't invoke/quote POFA anyway. So if they didn't quote they were using those powers, does the 14 day limit even apply or am I clutching at straws? |
