The driver of the vehicle got a parking ticket from Gemini Parking solutions in Stratford. There were no signs anywhere and no indication of this being a private property
Should this be ignored or contested ?

Get the driver to go there again and take photos of the lack of signage.

This will be appealed by the keeper so that the appeal arrives about 2 days before the end of the period allowed.

Appeal it on Day 26 as the keeper, NOT the driver - poor signs

Use an address that's slightly different from the vehicle's V5

Gemini must serve a Notice to Keeper between 29 and 56 days after the parking event if it wants the right to recover payment from the keeper
One of the conditions is that it obtains your details from the DVLA

The slightly different address will reveal if they paid the £2-50 or used the details on file from your appeal

Here are the pictures. Should the keeper appeal by email as that is also mentioned in the instructions ? Or is post the preferred method.
Also is there any template for the appeal ?

The entrance is on the left hand side here (Google Street View)

The car was parked behind the VAN

I don't see any signs...

They got spanked at court on another thread - perhaps they'd like that again?

How on earth would anyone know you can't park there?! Reminds me of their poor signage at the location I parked at. I won my case yesterday by the way.

When you appeal as the keeper then send those photos and ask them where are the alleged signs that they allege created the contract.

Should I just write a simple letter and send it across with the photographs saying that I appeal due to lack of signage, and also write a slightly different address compared to the V5 ?

Yes, appeal as the keeper And use that slightly different address, sufficiently different so that you know it is not obtained from the DVLA but not too different that any reply will not be delivered. First class post and Certificate of posting from a post office.

Many thanks. Can I ask what is the significance of appealing exactly on the 26th day ? The reason for asking is that the keeper might be on holiday on the 26th day so a couple of days before is ok or would that create any issues with the appeal ?

The reason is that they have to wait till day 28 to get the keeper details from the DVLA. If you give them those details then they save £2.50 by not applying to the DVLA. However having had communication with the keeper they may not bother to issue a Notice to Keeper. Either point is a failure at POFA and therefore there can be no keeper liability. Sending towards the end of the 28 days gives them less time to realise the mistake and send a valid NTK before the 56 days is up.
The slightly different address gives you the chance to detect if the have been to the DVLA or not.

Many thanks. I will try and send it as late as possible. Also should I take into account 2 days for first class post ?

There are some words painted on the road at the far end - looks like a bay of some sort. What do the words say? Can't read them from the photographs?

I assume there are no comments / revisions that should be made to this letter?

Reason for asking: I will be sending a very similar one.

Looks OK

Don't forget to provide a name or address that's slightly different from the V5

Change the title to "Appeal from the keeper" the other wording sort of suggests that you could be something else as well.

Please keep it in your own thread. To post in someone else's thread causes confusion. Delete your post content but by all means put in a ling to your thread.
