TFL PCN - parking on a footpath

Hi all,

I received a PCN yesterday from the TFL and I was wondering if there's any way around it because I'm a student & just paid another £65 parking ticket last week & can barely afford it!! sad.gif

Basically the location where I was parked is very weird, it is on the side of the A12 (dual carriageway), its not really a footpath and I've always parked there along with other cars with no problem at all. Here's a link:

I live behind that white building & have always parked here. The only problem was someone was blocking my usual space by the side of the fence so I had to temporarily leave the car forming a second file on the "footpath". I was parked there for minutes before going back to check on my car to see if my normal space had free'd up and saw the ticket. There were about 4 other cars around me and none of them got a ticket!

Is there any chance I can challenge it or just ignore it? Any help/advice is much appreciated!!

P.S when I go to check the status of the PCN on the TFL website it says there's no match in their records?

My first question would be---- is TFL the enforcement authority? They might be the highway authority but this doesn't look to be a red route. Has a wandering CEO the authority to issue a PCN in these circumstances?

I'd be very surprised if TFL were not the authority given the road.
But no obvious signs like Red Lines except for a set of DYLs in the bus stop opposite.


This seems a nasty one.
It seems obvious that parking is allowed on the building side, call it discretionary if you will but accepted.
But a second file would seem to infer on the actual footpath.
Need to see CEO photos to be sure.

OP got a PCN because he was actually parked on the foopath with the paving slabs, not where GSV shows cars by the railings. Clearly they tolerate parking by the railings, but a car on the footway is fair game to them, hence the PCN. Difficult to think what appeal argument there is here. The legitimate expectation argument would be if a PCN had been issued for a car by the railings, and that would succeed, but I don't think this one would.

Well no, but the OP claims in his first post that that is where he parked.

You just explain the circumstances, say you're very sorry and you'll never do it again, and ask them to exercise discretion to cancel the PCN.
