Claiming Costs

What part of legistlation needs to be quoted to remind them they could have to pay costs if they insist with rejecting an appeal...

I would like to include this in my standard first letter to council's on appeals. They try and remind you that if you don't pay it will cost 50% more. I would like to equally remind them that they will have to pay for the companies time...

It is your right to appeal, and go to PATAS, section 7 in the SCHEDULE 6 RTA 1991.
If they fail to allow an appeal, then they breach also your human rights.
YOU must have an appeal form from them and they try to fudge it, and not send one out. It's deception.
There is a body of evidence to confirm this is true.

I hope its what you want, you are just a bit ambiguous but I tried to hopefully provide more than needed.
Costs are difficult, there is a case going on now, for that and it is being watched closely.

the rules on awarding costs are narowly drawn and even more narrowly interpreted

see patas key cases on costs


i have a claim for costs and am going to appeal if they turn me down

a claim for costs outisde the npas/patas system probably has more hope
of success based on maladministration - this requires yuo t prove that thye knew
or shoudl have known thye were acting incorreclty

with patas you have to prove they were wholly unreasonable or vexatious
and apparently being lazy and incompetent and telling lies does not suffice
