Hi, my husband , (the registered keeper)received a PCN for car parking From Highview after Christmas for an apparent 2hrs18 mins stay on land at Robin Park retail park, where there is a 4hour limit usually but a 2hour limit on match days .
The car park does have a sign stating this but how does anyone know when matches are going to played when there is NO other signs stating that “today is a matchday” or something similar! He is going to Appeal “ that as they are not relying upon the protection of freedoms act then the keeper (my husband) isnot liable, as the keeper was not driving -“ But my question is this, who does he send this appeal too.? Highview or POPLA? Thanks in anticipation as it is worrying when this has never happened before. |

If you haven't appealed to Highview then you will not be able to appeal to POPLA without the code that Higview give when the appeal is rejected.
How does he know that they are not relying on the Protection of Freedoms Act? POFA allows the keeper to be held liable even if they were not driving. Post up the PCN received, suitably redacted of identifying info but leave dates. PHotos of the signs would be nice. |

If it's a Highview PCN then it's non-POFA, as we know, unless they've changed the habit of a lifetime.
But we did see them outsource NTKs a month or so ago, to PCN Admin/ZZPS, who fielded an attempt at a POFA PCN but wrongly stated the amount as £60. So it will depend what you have there and the best (winning) one is a Highview headed notepaper one. |

Can we see all of it, with identifying details removed, but leave dates. Probably the reverse as well
The registered keep has to appeal to highview but as we don't know what was on the PCN then it's difficult to help |

After trying for 2 hours last night to upload photos of front and back of PCN., I have to admit defeat.
Not all forum entries ask for the photos of the PCN but if this is necessary in our case then I have no option but to PAY this ludicrous fee. Thank you |

Did you try both tinypic and imgur ?
IIRC one of them is no longer working as per the Forum instructions If all else fails post your original picture again but much smaller resolution An A4 document never has to be more than 1000 pixels high to be readable Nobody has to pay Highview This post has been edited by Redivi: Mon, 31 Dec 2018 - 11:22 |

So why pay? a lot of people upload pictures so it's not impossible Sign in to a picture hosting sight (the link you were given suggests Tinypic and images shack. There's also imgur https://imgur.com/ You load you pictures on those sites and then insert a link to that picture in this web site. At a pinch you copy and paste the address from the top of the webpage diplaying your picture into this forum. If you are using a tablet or phone it can sometimes be more difficult than if you are using a desktop.
There is a limit on the amount of space that this site can provide for pictures etc. You do not use that allowance if you put the picture elsewhere and provide a link. If we can't see the PCN how the heck do we know what to argue against. Yes most of the regulars have a good idea what will bi in a PCN from a particular PPC but every now and again they make changes, which means the advice changes. Just need to see the image so that a good response can be provided. All we got from your image was that it was Highview and it was Robin retail. No indications on the presence of POFA required statements, or lack of. ...I have no option but to PAY this ludicrous fee. You have several options, not just that one. Does the Notice to Keeper reference the Protection of Freedoms Act anywhere on it? If it does, what does it say? Other posters on the many threads on here seem to be able to host their pictures online and post a link. Not sure why you are struggling with this. Which ones have you tried? -------------------- Sometimes I use big words I don't understand in an effort to make myself sound more photosynthesis.

I have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to give the warning to the keeper, contrary to section 9 (2) (f) of the Act. You cannot therefore transfer liability from the driver at the time to me. There is no legal requirement to identify the driver at the time and I will not be doing so. Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct. In accordance with the instructions on the PCN.
Being Highview, you could start the stopwatch to see how long before they cancel. I know of a record of 2 hours, but I believe someone else managed to beat that. Let's see how fast yours is!!!! -------------------- Cabbyman 11 PPCs 0
