Hello,
First time poster, long time Just received a parking charge from Civil Enforcement Service for £100 while the driver was at Wycombe Rye Lido for 14 minutes waiting for the girlfriend to finish her park run. Attached are the images. They didn't pay for parking however they didn't park, there is no parking on a Saturday morning as its so busy so after dropping her off they went away and came back to collect which took slightly longer than expected (In this case 14 minutes) vs the allowed time of 10. IMPORTANT!! Edit the first post so that the identity of the driver is not inferred. Use "the driver ......." etc. Do it now!! The letter to send: Dear Sirs, I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. There is no legal requirement to name the driver at the time and I will not be doing so. I do not expect to hear from you again except to confirm that no further action will be taken on this matter and my personal details have been removed from your records. CEL will cancel by next month, these are VERY EASY as long as no-one adds words blabbing about who the driver was. |

When it has been cancelled forward it on to trading standards as a company trying to claim rights that they are not entitled to, ie claiming money as a result of keeper liability when they know they are not entitled. Even PE do not issue claims for POFA liability when they know the have got it wrong
