PCN - Parked on Pavement while loading, Helping a disabled individual with nowhere to park Options

Hi everyone,

I would really appreciate any help I can get on this matter. It is rather late in the day due to life getting in the way, and I only have a couple of days before my ‘discount’ rate expires. However I remembered this site, and thought it may be worth a try to get some advice.

My friend is disabled and lives on a main road. They required help to take things to the skip, and my only availability was on this particular day not long before skip closing times.

I checked both the road to the side of their home, as well as the one opposite, and there were no bays nor spaces for parking available for the 15 minutes I was driving around. Even the one loading bay was taken.

So, I did what I and many others have done before on this road when ‘loading’; I parked opposite their home, on the pavement, well out of the way of where pedestrians traverse.

I parked, removed the parcel shelf from the rear of my car in order to lower the seats, and walked inside to place the parcel shelf down, and spent about 2 minutes at most, picking up the first heavy box in the hallway and manoeuvring it to the door.

As I walked out, there was a Community support Officer, taking photos of the car, and had issued me a PCN. The times on the photos are literally as I walked out after the PCN was issued. He subsequently turned off his body cam, and advised I appeal the case as he understood my concerns, but ‘very kindly’ placed the PCN in an envelope, and then on the car, and said I can now continue to load the car at my leisure!

The key thing here is whether I have any grounds for appeal.

The person whom I was helping has a disability which can mean they are bedridden at times, and this was one such time. Therefore I had no choice but to walk away from the car when loading things, and there was no other reasonable space nor time to have this done.

I can prove their disability, but not that I was loading, even though I showed the officer the corridor full of items, and he suggested he would make a note of that, nor that there was no other reasonable space to park.

I was out of the way of pedestrians, as there was another 2 metres between the car and the rest of the walkway, and certainly not obstructing traffic on the road.

Any help on this matter, prior to my paying the discounted rate, would be greatly appreciated.

I wouldn't get too carried away with this.

Pl contact the tribunal NOW. Not 'next couple of days', it is very important.

For example, if your submission was not received and no appeal has been registered then you would need to submit a statement of reasons why your appeal is late and ask the adj to nonetheless register the appeal.

I would not be impressed if even your late submission was later than it needed to be because you could only be bothered to pursue the matter 'in the next couple of days'!

I have contacted the London Tribunals and asked them about this. They have stated that they did receive the appeal, and that it was specifically registered today and is being processed. I have received a reference number, and the CC will supposedly be cancelled in due course. I will receive further correspondence regarding the appeal in the post in the coming week or so.

I asked to clarify when TFL were informed about the appeal, as well as when the appeal was received, and the response was only that the appeal was received and would have taken a few days to process, and it has now been registered today. No specifics regarding TFL were given.

If I have failed to ask any more pertinent questions, please do let me know, and I will call again for further clarification.

No that's fine, you will hear from the tribunal in due course and receive an evidence pack from TfL we will need to see that as soon as you get it
