Hi guys, I could really use your help on this one. It seems there was a bay suspension directly outside my house which I was unaware of. I walked out to the nasty little surprise of the yellow sticker on my windshield. However I had no idea - I only found out after I received the ticket. The suspension started on 08/09/20 at 00:00:00 however I do not recall seeing the sign and I was parked there all day with no nasty surprise. The suspension was for one parking size outside number 10 and number 12 - I happened to be parked at number 12 and I do recall some work happening on the 08th but it also finished on the day. Also the one and only in that displays the suspension is not even anywhere close to where I parked my car. I don't pass it at all from the time I entered the road, to parking and to walking in to the house. The sign is fixed at the other end of the road.
I have included photos of the sign and the ticket. I have also included screenshots from google maps showing where the car was parked and where the sign is. I genuinely had no idea that the bay was suspended. |

First of all, I would like to thank you for your help. I appreciate it a lot and I am very grateful.
I will create a folder and share once they have uploaded any evidence. The letter they sent me that I posted states QUOTE We have sent a copy of your appeal to the Enforcement Authority. The authority is unlikely to participate in the telephone hearing. You should receive a copy of the Enforcement Authority’s evidence directly from the authority at least three days before the telephone hearing. If you have been issued a verification code by the Enforcement Authority you may also view the evidence via the appellant portal on our website. I am assuming that they will provide the same photos as evidence that I posted up from the council portal. The tribunal portal does not hold any evidence. Select "the alleged contravention did not occur". You don't need to upload anything at all right now. For the hearing, select yes (you can always change it later if you want). We know the sign was put up at 2:46 pm on 5 September 2020. Regarding what you said, can I ask how we know this information about the sign posting? I am assuming that they will provide the same photos as evidence that I posted up from the council portal. The tribunal portal does not hold any evidence. They will provide the same photos, but they might also mess up the evidence pack. I've had one case this week where a council forgot to upload the formal representations and the NoR, which is an instant win. If the council contests the case, the tribunal portal is where they will upload the evidence. Regarding what you said, can I ask how we know this information about the sign posting? Also where can I find the log of cars recorded at the time of the signage being put up? Post 24 above, the text in italics is from the council. Yes, because you can argue that if there were no cars parked, they would have a blank log that confirms there were no cars there when the signs were put up. If however a log doesn't exist at all, that suggests they just didn't bother, so they have zero evidence to indicate your car wasn't already parked there at the time. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

The enforcing authority have just uploaded this in the tribunal portal. Does that mean that they are dropping the case?

You'll get confirmation from tribunal, just keep an eye on emails and portal.
