Newham parking ticket

Hi All,
I parked my car last week in newham and received a panalty ticket. The parking sign was fallen off from the pole next to my car. The next sign was a disable bay and after that there was a sign which says parking permit holders only. Most f the signs in this area were vandalised. Any idea wheather i can appeal for this?

Each bay is governed by its own sign. On the evidence we've seen so far, I'm not sure the council can prove a contravention has occurred.

As its one long bay and there is a disable bay in the mddle. There is a sign on one side of the disable bay but the sign on the other side has been taken off. So I am right in thinking even though the sign on one side of the disabe bay mention the permit there is no sign on theother side, hence the bays after the disable bay is not covered by the sign on the other side of the disable bay?

A bit disingenuous?
The sign the CEO showed is on the same bay you parked in and between you and the disabled bay sign so the latter

Has been for a long while so a clear failure to maintain.

But I'm wondering how an adjudicator would view this; sympathy being a significant element.
They might easily think you were just taking advantage of the missing sign and conclude that the one that
is there is sufficient, along with other clear indications parking is restricted in the street.

Thanks for the reply. Unfortunately this isn't the case. Please look at the house behind the sign. You will notice it's after the disable bay and not on the side I parked. There were no signs in the side I parked after the disable bay.

cj2002 I think, based on the council photos, that you have a compelling case. It looks like they're relying on the photo of a sign in a different bay. You've got photos showing the sign next to your car had been vandalised. Can you take a photo to show where the other (non vandalised) sign is, in relation to where your car was parked?

No there are less parking signs now and also the parking bay has been shortened due to a new house being built at the end of the road. You will have to look at my road layouts and the pictures then it will make sense.

You need to make informal representations to the council first, if they reject, the registered keeper will get a Notice to Owner and formal representations need to be made against that. If the council reject again, it's only at that point that an appeal can be made to the tribunal.

If you get the pictures, we'll draft your representations for you. Yes you will need to attach the pictures to your representations / appeal.
