Hi, I'll try to keep this brief, as I couldn't find the answer elsewhere.

Received parking charge notice after the driver (who was not me, the registered keeper) apparently didn't pay. There are photos of the car entering and leaving the car park. The driver thinks they did pay - they were visiting me in the hospital several times a week and used the same car park every time. There is no proof that they did pay and none that they didn't other than the company's say so. I think the machine is one where you pay for a certain amount of time up front.

From what I can tell, the contract is with the driver, but the papers say that since 29 days have passed then the responsibilty lies with the registered keeper. I don't really understand how I can be liable for a contract I had no part of.

The reason I hadn't dealt with it earlier is I was in hospital for pregnancy and had the baby prematurely so things have fallen a bit by the wayside.

Any advice would be appreciated - should I respond or await further communication? The amount is £70.

Many thanks in advance!

The Protection of Freedoms Act (if they've complied) allows them to pursue the keeper from the driver's unpaid parking charge. The (alleged) contract is always with the driver but you can be pursued for it.

You do have the option to name the driver of course (prior to commencing proceedings).

What sort of 'court threat letter'? Is it a Letter Before County Court Claim? (And mentions debt pre-action protocol?)
