Received a request from Police Scotland on 05/01/2019 to identify driver in relation to a speeding offence - 73 in a 60 zone - alleged offence was committed on 16/09/2018. Completed the request and acknowledged that I was driving but also sent letter asking why the letters hadn’t been issued within 14 days of the offence. Now have “offer” to take 3pts and £100 fine as there is no option to do Driving Aware was course in Scotland. No acknowledgement of the letter I sent requesting confirmation of why they weren’t following procedure which they haven’t responded to.
Any suggestions as to whether it is worth fighting and how to go about it? |

NIPs are very rarely sent out late without reason, so let's see i we can work out why. Why not call them and ask?
Is the vehicle registered to you? Please don't guess - get the V5C in your hand. Is the name and address exactly correct? What is the DOC REF DATE at the bottom of page 2? This post has been edited by peterguk: Sat, 12 Jan 2019 - 00:51 -------------------- |

These days, with improved police back-office procedures there's usually a valid reason for the delay which would eliminate the 14-day issue. It is only the first NIP that needs to be "on time". If you decide to fight it, just decline the FPN offer and it will ordinarily go to court automatically.

To add to the above, there was no "Late Request to identify driver".
The 14-day limit applies to the NIP, not to the accompanying s172 request for driver details, for which there is no time limit. |

Have you checked that the V5c registration document is all correct?
Can complete the NIP Wizard (link top right) including the additional questions and post the output please. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Any suggestions as to whether it is worth fighting and how to go about it? Is the name and address on the V5C 100% correct? Is the V5C registered to your name and address? -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
