Hello,

This is my first post so please bear with me.

I have received a PCN for entering a Pedestrian Zone on Ripple road in Barking. I have googled and can see this is a hotspot for getting tickets. I entered on a rainy night and did not see any signs which said pedestrian zone (maybe I wasn't looking hard enough). Is there any grounds for appeal? I have attached the images they have given me. I can't see me passing any signs on the pictures either.

Please let me know if you need any more info. I'll try and provide

Link on Google maps I think is this one, but not entirely sure as it was my first time in the area

Post the PCN and a link to the location on Google Street View. Use imgur.com to host the images if you run out of space.

You need to post a link to the exact location on Google Street view, not Google Maps. I don't have time to look for the location.

The only avenue I can see is that the discounted period is given as 14 days from the date of service of the PCN, while it should actually be 14 days from the date of the PCN, see the first part of ground 5 here: http://forums.pepipoo.com/index.php?showto...p;#entry1388980

They've fixed the charge certificate date so that ground cannot be used. In the mean time ask the council for the footage.

The contravention date is 14th October which is a Sunday.

The signage is as clear as mud but surely the contravention cannot be sustained if it's a Mon-Sat restriction:-

Or does it mean loading is allowed Mon-Sat and all vehicles except buses are prohibited?

Whatever----the signage is clearly inadequate under LATOR 1996.

Good point, I think that's a good argument.

I wonder if I'm too late in response to this, but I received a PCN for this stretch as I foolishly followed google maps on to the road during restricted hours.

B&D produced a very robust response to my independent adjudicator appeal, providing the video evidence, photos of the signage and also verification that the signage was "signed off" as suitable by the appropriate authorities. I thought my ship was sunk.

I won the appeal as the judge sided with me on a number of grounds. I argued that the contravention didn't occur as my car could be seen in the footage, but no signage could be seen in that footage, making it impossible to demonstrate that I observed the signs (your photos also show no signage). The judge also agreed that the sign they sent pictures of is not possible to read and comprehend at driving speed as it is overly complex.

Good luck, you should have very good grounds for this being dismissed.

It would be beneficial if you could post the adjudicator's decision under this thread http://forums.pepipoo.com/index.php?showtopic=90145

Ooh unfortunately I binned the paperwork before I realised it could be helpful to others. Am I able to request the decision paperwork again from the authority?

If you know the case number and/or (approx) date of hearing you should be able to find it on the London Tribunals websaite
