HI i hope someone can help me out i am being harassed by civil enforcement ltd. I parked last year outside my own home but private land and i believe my parking permit had fallen on the floor when i got out of the car. A week or so later i received a parking ticket from civil enforcement demanding £100 to pay them which i ignored on a friends advice. I subsequently received many more letters demanding money from them which i also ignored but today i have received some sort of court claim form which is a bit concerning and i really do not understand iff it is real or another one of there ploys. I would be very great full iff someone could advise me concerning this issue as i do not want to end up in a court. I am attaching a pic of the part of the letter.

I seem to have misplaced my papers for the hearing date I am looking for them I think I have an idea where they might be. I will post up the hearing date when I locate them

Hi i have phoned the court today to confirm if in fact the case is discontinued and the court has confirmed that the case is in fact discontinued and that i do not need to appear in court.

I understand, but that's just encouraging them to continue, if you hit them with costs you make them using court as their final collection letter less profitable and may dissuade them from victimising people in the future.

What would be the process to do this. As you may be aware I am quite inept at these court matters and was more or less spoon fed on this forum to even get thus far. Iff I need to start claiming costs and start writing letters to court etc I won't know where to start.

Well, its basically that
You write a letter to the court, asking that the hearing is either converted intoa costs hearing, or the court considers the claimants unreasonable behaviour on the papers YOu then list all the ways theyve behaved unreasonably - including, if this disctoninuation was within 7 days of the hearing, THIS action in stopping the claim. They had no true reason to disctoninue - they clearly never intended to see a defended claim through to a hearing in the first place. |
