Bus Lane Contravention, Enforcement notice and car clamped

Hello,

I woke up this morning to a knock on the door for £500 enforcement notice for an ubpaid penalty of £65 for being in a bus lane.

All the letters where sent to my old address and therefore i havent paid.

The guy put a clamp on my car, as it was 7.15am i couldnt ring anybody county council or banks for example so no way of getting things sorted.

I couldnt take my kids to school or go to doctors appointment. im out of work at the moment so no way of being able to pay the £500.

Can someone give me some advice and how do i stand with any payments

When did you move and what is the date of the PCN.

Have you since updated the V5C reg doc.

Bus lane PCNs are sent by post to the name and address on the V5C for the vehicle as it is the registered keeper who has full responsibility for either paying or appealing. All subsequent enforcement documents are sent to the same address, and in the end, if no response is received, the debt is registered at the Traffic Enforcement Centre at Northampton. Following this a final statutory notice is sent out to the same address, an Order for Recovery.

So it does sound like you have not updated your V5 for some time. It is possible to submit an Out-of-Time Statutory Declaration that the PCN was not received, but being OOT means the council can, and invariably will, object, following which the OOT is rejected. The appellant can request a review of the decision by a county court judge, but this costs £100. This week we have a thread where the OP submitted an OOT for a Transport for London PCN, and got it accepted, but this is very rare; TfL must have been asleep at the time !

So what did you do about mail redirection following a move, (assuming this is the reason for non-update of the V5C)?
