Hi


The driver needed to find some parking, and saw a gym one and assumed it was free. The driver left the car for about 10 15 mins. When the driver got back saw the parking notice charge. The driver then realised there were some signs around, even though not very clearly posted especially near the entrance .

It was from UK parking patrol office, and they are asking for £100 or £60 within14 days

I appealed this and they rejected it. I then tried to appeal to popla , however it states I need a 10 digit reference number. I emailed parking patrol to ask for this, and there reply was

"Please be advised that as we are not subscribers to the Ombudsman scheme we are unable to supply you with a POPLA code. If you would like to seek independent arbitration of your appeal then you would need to do so with the IAS, see our initial response"

What can I do now if anything ? I have pictures too if that helps , but I am not sure how to upload.

Indeed. You don what th eform says
Every thread you have read says that, from now on (DQ onwards) you send EVERYTHING to BOTH the claimant and the courts. You MUST do this. Failing to do so is a breach of a courts order and you can find yourself losing.

'Oh gosh, I just didn't find the wording clear so I wasn't sure what I needed to do, I was also currently moving house so I only send the court form and not to claimant. I did make a copy and I can send it now but I have passed the deadline. Maybe I should just pay now as court will add more costs if I am most likely going to lose anyway, the overall cost has already creeped up and I will struggle to pay 250 quid.

Don't pay them.

Forgetting to send them a copy will not adversely affect your defence. The court will soon send out it's directions.

Dont just pay it now. You get discouraged far too easily

You cannot, from now on, make the same mistke> The DQ isnt a biggie. Send your copy in, dont make any mention of it being late.

Thank you, I did send the copy and nothing negative happened. And then at the beginning of Feb, the court ruled in my favour striking out the claim without me having to attend. It stated because no course of action and no facts upon which a cause of action could be inferred. I thought that was the end of it and then my family gave me another letter, which shows BW have appealed this decision and the date is now set for next week. I have actually moved months ago and updated my log book. Only by chance I had this letter given to me, but I feel this time is way too short now. I have read the posts and I am a bit confused. I already gave my defence, so what am I supposed to take to court? The same arguments again?

Is the hearing to decide whether to reverse the strike out, or has the strike out already been reversed and the hearing is to decide whether you owe the parking debt?

I am no expert but please try and answer the people who know what they are talking about the best you can & with as much information as possible so they can help.
I do know that when dealing with official court documents you must get it right otherwise you can end up the loser and it's exactly what the parking scammers want to happen.
It's a tool for them to collect a invoice and get you to pay up but has consequences if get it wrong BUT please people who stick with it win...

Hi I think it is to reverse the strike out. It states 'The hearing of the claimants application for relief from sanction'

Then attached is the application notice and section 3 states

The claimant seeks an order
1. The order dated X FEB be set aside
2. The claim to be reinstated
3. The claim to be relisted for a small claims hearing

Yes, theyre trying to get the strike out set aside (making it as if it never happened) and yo udont HAVE to attend.
Your log book is uttelry irrelevant. IF YOU MOVE you must inform them that you have moved. ADDRESS FOR SERVICE IS....

Not hugely - this is an argument between the court and th claimant
You might get asked whether you knew what was happening *basedon the claim form* and they may try to claim that based on prior documentaoitn the claim form didnt have to be too detailed - except it must still show a cause of action, and it didnt.

Did your claim have the added £60 etc for "debt recovery" or other such nonsense? If so take along, FROM the MSE forum, the strke outs from other courts AND the 6 page set aside judgement for the same cause, to showthe court can also strike out the claim due to this abuse of process. That might tip it further your way.

You should be able to claim costs to attend, if their set aside is denied, the usual mileage parking and a MAX of £95 for a half days loss of leave OR earning, TAKE PROOF

Hi guys good news, the judge ruled in my favour again, and rejected the appeal to overthrow the previous judges cancellation. BW legal were not happy , they were representing UK parking patrol. They are apparently going to appeal again, but hopefully it should be the end of it now. I forgot to take proof of lost earnings and time away from work! If they do send anything else, I will for sure add that on.

Whether UKPPO want to appeal again, I guess that might be a different matter.

Yes I think they this will be the end, I received the letter confirming all of this. I doubt any judge will consider this again as two judges have ruled against them! The BW legal was so patronising and talking down to me after the case, ' do you understand what happened here.' I said yes I won smile.gif

I am so relieved and so grateful to all of you guys.
