Welcome Break services, Who do you pay ?

Has anyone paid to park at a Welcome Break services ?

If so, who does your bank/credit card statement say that you paid - Welcome Break or ParkingEye ?
If you have a receipt, the VAT number will be equally useful

The payments for parking at Welcome Break's are taken normally in the WHSmith shops and entered onto the ANPR system after payment.

The receipt is the same as any other from WHSmiths in Welcome Break, they don't put parking charges through any other till system.

Parking at the location I have in mind is free to hotel guests

I've therefore got a suspicion that ParkingEye's income is from the Parking Notices and Welcome Break receives the normal payments
I don't however have a copy of a contract to prove it and there's a Forum thread where WB says that ParkingEye offers parking in its own name

I believe that if you are staying in the on-site hotel, the hotel has a machine where you enter your VRM and it comes up on PEs system as paid.

It's a court case

I was trying to determine who the motorist contracted with when he paid to park and was asked for the wrong amount

ParkingEye has since confirmed that it receives the payments as the contracting party and claims that the attendant that asked for the wrong amount is a third party and it's up to the motorist to check that the payment is correct

In my opinion they contract with the entity receiving the money but that the entity the pay the money to (W H Smith?) is their agent and as such any failure by the agent is the same as a failure by the main entity, so if PE get the money by W H Smith acting as collector if WHS make a mistake thats tough on PE. The same would apply whoever the money eventually went to.

However without some background as to the nature of the error its impossible to comment more fully.

That's the central argument

The payment was made along with larger purchases so the parking charge wouldn't be easily identified

The driver told the entity how long he had stayed and the entity calculated the amount

ParkingEye's reply to the defence says that the driver should have questioned the difference from the signs
The entity had already told the driver that he'd allowed a discount

If the correct information was given to the agent who then asked for the wrong amount to satisfy the contract then that is the fault of the agent, that's my opinion.

When you say defence, is this now at county court stage (via MCOL)?

I'll have to contact the Defendant because he hasn't mentioned a DQ
