I SORN'd my car and it has been parked (since it was SORN'd) on a private road with a gate that is occasionally closed at night. The road is not patrolled by council parking attendants as many people park their cars here for long periods of time.
One side of the road is exclusively used by Travis Perkins staff, who also close the gate from time to time. I recently discovered my car was missing (17th) and i called trace who told me that NSL on behalf of DVLA had lifted the car. They told me to wait for the letter, which arrived in the post tuesday. First thing to do is check the vehicle status

If you did it online, you should have an email confirmation, if you did it when you sent the tax disc back, and you got a refund, you can argue that they received the SORN application. If it is SORN, then you are into whether your gated private road, which is used by the general public constitutes the Public Highway, I suspect that the italics mean that it does, in which case you cannot leave a SORNED vehicle on it. |

If it is SORN, then you are into whether your gated private road, which is used by the general public constitutes the Public Highway, I suspect that the italics mean that it does, in which case you cannot leave a SORNED vehicle on it. It would depend on whether Harroway Road is a Public Road or not - s.62, Vehicles Excise & Registration Act 1994, (a road repairable at public expense), not a Public Highway. The gates (behind the blue car and the silver car at the top end of the road) have Travis Perkins signs on them, but looking at the grass around them, it doesn't seem as though the gates are closed very often, which appears to allow the public access to the road. If this is so, I believe that the road does not count as 'off road' for SORN purposes.
As said above, check that the vehicle is shown as SORN on the DVLA website and check the status of the road with the LA. The car will have been disposed of yesterday if you didn't collect it. |

It is the status of Harroway Road that is relelevant - a Public Road or not - as far as the requirement for a vehicle licence or SORN is concerned, not public access. |

It appears the DVLA do not accept the vehicle was SORNed, has the OP received any acknowledgement of his attempt to declare SORN?

The OP does have confirmation of SORN - I saw it today myself - dated 1.3.14

The OP does have confirmation of SORN - I saw it today myself - dated 1.3.14 Then he needs to contact NSL and point out that the vehicle has a valid SORN, and was parked on a private road not maintained at public expense, so no offence was being committed and they need to release it and compensate him for the inconvenience caused. -------------------- |
