NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - July 2014
Date of the NIP: - 5 days after the offence
Date you received the NIP: - 9 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A90 Petterden
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - Not known
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Visiting Scotland, overtook a vehicle, came around the bend and was in the process of moving over to the left hand lane. I only noticed the second flash (GATSO), requested the photo evidence, and the camera took two shots, but it is difficult to quanify the speed from the photograph. The radar registered a speed of 81MPH - which may have been correct as I normally travel mid to high 70's on the motorway. I live in Swansea, so being taken to court could be costly as the speed camera partnership have informed me that any prosecution would happen in Dundee which is the other side of the country. I think if they make me travel to Dundee, I'll bring some thermite with me and lumberjack the bastard camera smile.gif

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - Scotland

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

Depending on your circumstances, you may wish to consider completing the form, but returning it unsigned. By doing so there is a risk that you will be convicted under s172, which would attract 6 penalty points and a fine; in most cases this is likely to exceed the penalty for the speeding offence itself.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

What are you asking us?

You know you were driving and the speed you were travelling at. As this is Scotland, it's £100 and 3 points - you won't go to court for it......

You could go the unsigned route but hardly worth the hassle as you have a clean licence.

"The radar registered a speed of 81MPH - which may have been correct as I normally travel mid to high 70's on the motorway" If you do that on A roads as well you are going to come across cameras.

...I will if I don't pay !

Interesting point, now Thermite may be the solution to the camera issue. BTW it was a Dual Carriageway at national speed limit (which is too low).

Tell us the court and the date and I'll bring some popcorn tongue.gif

Seriously though - take the £100 and 3 points it is the cheapest option. I cannot see you getting a not guilty verdict

As for the comment about thermite, I know it was meant as a joke, but the moderators on here don't like such talk

He'd need a defence for that - and since OP doesn't have one, that makes life a bit tricky...

Whether you think the National Speed Limit for a dual carriageway is too low or not is neither here nor there. You won't get much argument round here, but it doesn't in any way help your situation.

Accept the FPN will be the cheapest and easiest option.

Don't we? Thermite would destroy the camera but to "lumberjack" a shaped cutting charge or det cord might be more effective.

Indeed it would, but the only reason to shape the charge is to control, the collapse. Simple C4 will do the job on a 10' pole.

What's wrong with the traditional burning necklace of an old tyre filled with petrol?

Apart from not being very eco-friendly

I'm surprised that students don't pinch the whole unit...make a great bedroom feature next to them there cones.

If an engineering student they could set it up as an epic alarm clock.
