Hello everybody.
I read article somwhere on the net that one guy was caught speeding by gatso and was given ticket in the post. The charges were dropped when he proved that there were wrong signs before the camera. The sign he saw was The article stated that to make it legal to issue a ticket for speeding one of these two signs must be present before the camera. Where is the truth? |

The truth is that no signs at all are required.

As abovem, complete tosh, what is perhaps more likely was that the required terminal signs were not in place, poor reporting of speeding cases is the norm not the exception!

Is this in regards to an actual incident?
The are circumstances were incorrect or inadequate signs could see a cancellation - but the camera signs are unlikely to be the reason... -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

This did happen a few years ago in Cleveland. Two Police Offices challanged their speeding convictions because the black outline to the camera sign was the wrong shape. They won and had the convictions overturned. It was all over the local news and papers. The signs were just outside Guisborough where I live in a 50 zone, It was enforced by mobile camera.

Er, 10 years ago... here.
The article says the speed limit sign had the wrong surround - not the camera one? -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

As long ago as that? how time flies.
Here is a link to another piece about it. http://news.bbc.co.uk/1/hi/england/north_y...ire/3147201.stm It was the border around the camera warning signs that was 'illegal' |

It was the border around the camera warning signs that was 'illegal' The TSRGD lists the allowable formats - black border when used standalone but no border when combined with a 'speed limit reminder'. Difficult to tell what actually happened but the camera signs are not required as we know. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Clearly not just a camera sign!
QUOTE "The signs are correct, the size correct, the colour is correct and it correctly describes the speed limit." Either the red border or the backing plate being the wrong colour would affect the speed limit sign's legality, the fact the sign may have had a camera sign on as well may not be at all relevant. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

As I remember at the time it was a combined camera warning with a speed repeater on it before you got to the enforcement site.
This is the location now http://goo.gl/maps/Ze6Sn It's a 50 because there are several junctions in short succession into the village of Charltons, Boosebeck on the opposite side of the road, a Plant Hire place and a big Coach Depot. |

Well I was done by gatso two days ago on A316 coming towards Twickenham Rugby Stadium, the last camera down the hill before the junction.
I am so stupid. I saw so many times cars passing that camera at 50mph and nothing. I pass it at 53 and been flashed. What I was triyng to prove? So stupid. I got clean license so now that is gone. I read that article and I thoughtmI'm safe. Thnx for your help. I was always so careful and this time I just lost my head. My colleague said he was flashed by the same camera 8 months ago and nothing came so maybe I will be lucky too. Cheers. |

Here?
They would normally fire at anything doing 46mph... Wait and see if the NIP arrives in the next 2 weeks. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

In a 2007 case, the fact that a sign had a black lip around the casing was taken to be such a minor deviation that it should be disregarded as de minimis. See Canadine v DPP

Yep. The last camera before the roundabout with the Twickenham Rugby..
Couple of days before I was following other cars doing 50 but on my speedo 50 means real speed 47 and there was no flash. When I was on my own and going 50 on that hill car as I was coasting speed up to around 53 and then I got 2 flashes. I'm pretty sure now I've been caught. I never received a ticket as i was always careful so what should I do if I will not get this chance of going to the awerness course - is there a way to write a letter to the officer that deals with it and ask for it? At the moment I'm doing class 2 lgv license and many places to get the job require no points at all. This post has been edited by mcdziubek: Tue, 24 Sep 2013 - 21:39 |

is there a way to write a letter to the officer that deals with it and ask for it? The offer of a SAC is at their discretion, based on standard critiera. You can't ask for one if you're not offered one. Wait for the NIP. Name yourself as driver, and see what comes back. -------------------- |

When I think now about this situation I got myself into I think I was going more than gps 53. I hope not but now I started to think I was going around 60 so gps speed in my car is 57.I think the paranoia is getting me now. I was in shock when I saw the flash and I just can't remeber now what was my speed. Not more than 60 on the clock and not less than 55.
Now if it will get to the court and I will face ban from 7 to 28 days - is it mean that I will have to go through the driving test again? Will that ban also mean that I will lose my D PCV/BUS category too and will have to do it again? What about my new C LGV/HGV category that I'm doing at the moment? |

Remember that GPS speed measurement has a margin of error depending on your exact instrument, and is as likely to under-read as to over-read so your true speed may actually be higher than what you call your "GPS speed". |
