What is the name of the Constabulary? - Date of the offence: - January 2008 Date of the NIP: - 5 days after the offence Date you received the NIP: - 6 days after the offence Location of offence (exact location as it appears on the NIP: important): - main street towards chester road stonnall staffordshire Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Recorded If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 10 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - driving down the main street stonnall when a car in front of me was stopped talking to an on coming car witch also was stopped in the middle of the road. i waited for about two mins then sounded my horn to the reply on the car in front of me slowly pulling off and then going over to the oppisite side of the road at that point i got in front of the car and then the car i got in front of clipped by back bumper to witch i didnt know or feel he then started to follow me down the chester road i went round an island several times to lose him and did so. The following evening i came home to a piece of card with my name on and a number asking me to ring in witch i did to my shock hes saying i hit his car but not knowing how this person got my information and then within a few days recieved an nip with the offences of driving without due care and attention and driving without reasonable consideration. but how would the person whos saying i hit them beable to obtain my home address and number and also know my name and my parents name. when the only information he would have is my number plate NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

but how would the person whos saying i hit them beable to obtain my home address and number and also know my name and my parents name. when the only information he would have is my number plate Maybe he was an off duty police officer - or a plain clothes police officer? Maybe he was talking to the driver of the other car when you came behind him about his standard of driving. I'm normally optimistic about the posts on here - probably too optimistic for my own good sometimes. But TBH I think you're stuffed here! Whatever or whoever the driver was looks like he's made a complaint to the police about your driving. I would have thought they'd be duty bound to investigate this rather than just issue a NIP. Whatever happens next is up to you really. You'll need to respond to the NIP as the Wizard says within 28 days. Or it's failure to notify which carries 6 points and a hefty fine. Obviously you can't afford any more points so even if they decide to offer you a FP you're still gonna get a ban I would think. Soon as they see your licence it'll be a summons. Of course you can always go to court and contest the allegations? HTH |
