NIP Details and Circumstances
What is the name of the Constabulary? - Northumbria Date of the offence: - September 2007 Date of the NIP: - 9 days after the offence Date you received the NIP: - 13 days after the offence Location of offence (exact location as it appears on the NIP: important): - A189 Barrack Road, Newcastle Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was sticking to the speed limit of 30mph on the dual carriage way section, a porsche came right up behind me and was in my opinion dangerously close. I started to pull in and simultaneously he started to undertake me, my reaction was to accelerate quickly to a safe distance then slow down to the limit. I was involved in an incident 1 year ago where a vehicle wrote my car off because he changed lanes without looking, consequently I am very uncomfortable in similar situations. I also had my daughter in the car at the time. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Unsure Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

-------------------- Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.

Just goes to show the folly of speeding up unfourtunatly, as you seem to realise your reasons will cut no ice with the scammers..
Its worth asking for photo's to ID the driver, if two cars are in shot they shouldn't prosecute, if nothing else you get a souvenir for your money... For that speed its unlikley you will be offered a fixed penalty so it will be off to court, once you have the photographic evidence then it can be checked. What device was used? Thanks Simon,
Yes, folly it was! You live and learn. Thanks for the advice, I think my souvenir may be expensive . It may not be relevant, but the return address is to the 'Fixed Penalty Unit'? I have no idea what was used, there is nothing in the notice. Cheers |

I have no idea what was used, there is nothing in the notice. Cheers I know the scammers pretty well in that area. They are using illegal Gatsos in vans, the signs are appalling in the Newcastle area too and I know of at least three stretches which do not show the correct 30 sign on either side of the road which invalidates any summons. Take a ride along the route. Mark out all signs you see and whether they are on both sides of the road. The Central Motorway section has several turn offs which are poorly marked so chase up on this. Find out which device snapped you. Ask for photos to help identify the driver and get back to me via PM -------------------- The Asda shopping trolley parking ticket enthusiast
