Speeding sign posts and markings (Scotland)

Hi All,

At 18:14 today, i was overtakng a caravan and as i pulled in again, noticed a white transit van parked on the opposite verge,facing me, with the tale-tale glass window with a camera!!!!!! I looked at the speedo, and was doing 69 in a 60.

So, my questions are

In SCOTLAND, what the legal postion regarding sign-posts warning you of safety cameras ie how many, frequency etc

In SCOTLAND, whats the postion of having marings on the van, as from what i can re-call, it was totally white, and i thought in scotland they had to be visible.

Can anyone help.

If your speedo was displaying 69mph, then your actual speed may have been below the enforcement threshold (likely to be set at 68mph or above). Unfortunately, you will have the dreaded two week wait before you will know for sure..

I am not aware of anything in legislation, Scottish or otherwise, regarding signing requirements of camera sites which would provide a defence to (or mitigation of) an alleged offence detected in an 'unsigned' area.

As above - I am not aware of any legal requirement which states that the vans must be liveried before alleged offences can be prosecuted successfully.

There are guidelines laid down which suggest how sites should be signed and the conspicuity of scammer vehicles. However, non-compliance with these guidelines would not provide a defence to an allegation of a road traffic offence.

You might as well say that you thought that the moon was made of green cheese.
What is your source? The ACPO guidelines to which Nemo refers are for England & Wales. Apparently, in Scotland, the Lord Advocate issues such guidelines, but we haven't been able to source them. That said, we have seen nothing to indicate that they are any different that the ACPO (E, W & NI) ones.

Thresholds.

A police officer once told me the usual used was Limit + 10% + 3 mph.

Thus a 60 zone would be 69.

I don't think this is mandatory/written in law, but is more of an accepted guide. Based on the fact that they need to allow up to 10% for vehicle speedo errors.

They don't. There is nothing to stop them prosecuting at 31mph in a 30mph limit if they deem it appropriate to do so..

The ACPO guidelines for prosecution are 10% +2. Several forces used to (generally) only prosecute above the threshold - IOW 10% +3, but when they were allowed to keep the money, they started issuing NIPs at the threshold.
N.B. speeds are generally quoted in whole units of miles per hour (rounded down).
