Hi there,

I'm 20 years old and I was caught doing 51mph in a 30 zone. I have had no previous convictions and no points on my license. I have been issued a court order and will receive the papers in the next month.

What will the process be like? What will likely be my penalty ie how many points, fine etc.

I just want light to be shed on my situation as this has never happened to me before.

That’s odds on for 6 points. A fine of 1 week’s earnings, costs of £85 and surcharge of 10% of the fine (min £30 - although has gone up recently to £32 depending on date).

How long have you had your licence as the DVLA may revoke it under the New Drivers Act.

The process may just be a letter from the Single Justice Procedure. Without you needing to attend anything you get a letter saying this is the punishment accept it or go to a court in front of real people.
If you accept it (and pay any fine etc.) then that's the end of it.

the letter came back and I don;t have a choice. Im going to court. So what will the process be like? Are they gunna be quite mean

Speeding is a criminal offence, but not recordable, so no you won’t get a criminal record.

Thanks thats calmed me down. I quote the letter 'However, in this case, the severity of the offence recorded by detection device was such as to prevent the offer of a fixed penalty being made to you. Under the circumstances it is standard procedure for the matter to be referred to court proceedings. You will receive your court papers in due course'

What does all this mean. Am I definitely going to court?

Your case will be going to court, whether you go or not is up to you, if you plead by post the court is unlikely to require you to attend for sentencing (which normally only happens when they consider a disqualification).
