hi everyone i received this pcn in the post today, from what i can see they do not have any photographic evidence and also my car is grey not black, they do however have my license plate.

Post the other page(s) of the PCN, and grab the photos from the council website.

I can't see how you can get them form the council website, I think you'll have to email them and ask. Can you give us the circumstances of the contravention? Had you been loading / shopping / something else?

so if the date of notice is the 30/07/2018 i get 14 days after that to pay the discounted charge ? |

Photos are not a legal requirement, but most councils get their CEOs to take them. Car make and colour are also not a legal requirement on a PCN either. Are you sure you have told us everything ? Most drive-away PCNs we see are issued because drivers know they have possibly parked in contravention, see the CEO, and hurriedly drive away thinking they have got away with it. Unfortunately the Traffic Management Act 2004 put the kibosh on this little escape routine by allowing councils to issue the PCN by post. The PCN is for parking on a restricted street, so either single or double yellow lines is the most likely. Unless there is a loading restriction, there are two exemptions to the yellow lines, (1) boarding or alighting passengers, and (2) loading/unloading. If you are claiming either exemption, it is you that have to prove the activity, not them. As advised by PMB, telling untruths in reps is a criminal matter. even though PCN enforcement is civil. The 14 day period is from the date of service of the PCN, as the PCN states on the first page. This is assumed to be 2 days after the date of posting which the PCN also says is the date of posting. However you've got yours a day quicker but the 2 days is still applied to the period. |

They have 56 days to respond to formal reps made to a postal parking PCN, as stated on page 2 of your PCN.

If you made reps online, then they have until 2 October to serve their reply.
If by post, then 4th. No argument lies with you whether they wait this long or not, it’s their choice. In anticipation of a rejection I suggest we use the intervening period to find out the facts of the case now that we’ve dispensed with model and colour. Over to you. |
