Hi,
I recieved a default CCJ in the post today. From the county court business centre in Northamton. Claimant is civil enforcement ltd. The ccj is for a house number that doesnt exist, but our helpful postie worked out who it should be for. I live at 20, order is for 21(which doesnt exist). I didnt get any paperwork before this. Im guessing because it all went to the wrong address. The cost is 250 plus costs for the court of 97. Any advice would be appreciated. |

First things first - is the v5 for the car correct?
I wouldn't risk ignoring it - so you will have to apply for it to be set aside, this costs £255. You will need to have a reason to have it put aside (wasn't delivered to correct address) and that that's a prospect of success. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

What have you received; A judgement or just the initial claim?

You must have a current V5C for your car. Which presumably should have the same address as the one you live at, i.e. no. 20 This post has been edited by peterguk: Fri, 13 Jul 2018 - 14:15 -------------------- |

But the point was whether the DVLA records were correct or the parking company have 'messed up'. Either way, you need to get on with the set aside - you have a limited time to do this without further issues. (The rules say the application should be made 'promptly' - so no more than a few weeks) -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

So you haven't received your V5 after updating. It could have gone to Number 21 ! Phone up the DVLA and ask. You should have received it after 6 weeks max

If this was two years ago, you must have renewed your Road Fund licence at least twice
What address is on the renewal letters ? If it's correct, either CEL issued the claim to the wrong address or the fault was Moneyclaim's Either way you should be able to reclaim your set-aside fee This post has been edited by Redivi: Fri, 13 Jul 2018 - 15:53 |

I do all my renewals online now.
So during the set aside, would I have a CCJ sitting on my file? how long does the process take? I presume after that point they could just come after me for the money again, but probably with the correct address this time? |

I do all my renewals online now. What has that got to do with where the renewal letters were sent? Questions are asked for a reason, answering them helps us to help you, your choice...... -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Sorry, I found the paperwork. The address is the incorrect one DVLA paperwork? If so, incorrect delivery not the fault of the PPC. This post has been edited by peterguk: Sat, 14 Jul 2018 - 08:08 -------------------- |

It could be the fault of the FVLA. As we know the DVLA is far from perfect, the address could have been transcribed incorrectly.
But this does mean the claim was not delivered and therefore a set aside would still be possible. |

It may have been the fault of the DVLA, having 2 years to check it and a renewal in the middle suggests some blame can be attached to the OP.
