DART PCN a year after crossing

I crossed at Dartford on 5/7/2015 at 19:00. I was madly busy and forgot to pay the £2.50 toll by midnight the following day, but paid online less than a day later on 7/7/2015 18:49, I have the emailed receipt. I have not made any crossings since. I heard nothing more so assumed the payment had been accepted.

2 days ago (4/7/2016) I received a PCN dated 29/6/2016 saying I now had to pay the increased fine of £105 as I did not respond to a charge sent to me on 6/8/2015 for £70. This is almost exactly a year after the crossing in question. I definitely never received the first £70 PCN, why on earth would I just ignore it if I had received it? Of course they send them by standard post so there is no way for me to prove I never had it. Also morally I would have thought paying a £2.50 fee a day late was not the most heinous of crimes requiring a £105 fine, but then I know common sense and decency does not come into this.

Do I have a leg to stand on to contest this, and if so how, or do I just have to give in to the bullying tactics again?

Any advice much appreciated.

Softly, softly!

Have a look through the Dart Crossing threads here (use the search box at the top r-h corner of every page - uae Dart Crossing as the search term)

The Dart Crossing authority seem to have quite a good track record for being reasonable, so i suggest you try contacting them (telephone, letter or their Facebook page) - print off the e-mail receipt and enclose copy if writing)

Before contacting them,
As usual, for best advice please post up the PCN (both sides) you have received (is it a PCN or NtO?).

Do not attach docs/photos, but use this method:
Photo or scan. see http://forums.pepipoo.com/index.php?showtopic=36858&st=0
for how to do it. I use Tinypic for stage 2 with no problems.
STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image, and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post.

Using the attachmen
t method is not advised as it means quickly running out of attachment space.
Redact/obscure personal details, PCN no. Reg No.

Also post up a GSV (Google Street View) link to the location.
LEAVE IN all dates/times; precise location, Contravention code and description.

Thanks! Ok, breath.....

Here is the notice, there is practically nothing on the back, other than a note saying service of this notice is deemed to be 2 working days after the issue date shown overleaf.

So unless anyone can see anything relevant in this notice I should just contact them and hope they are reasonable?

As john say's it's worth giving them a call, have the proof that you paid to hand, to date our experience is that they are quite reasonable.

If you have no luck then the next step is wait for the order for recovery. This allows you to make a statutory declaration that you did not receive the PCn
and re sets the process, we can then look at a challenge


Is there any reason you may not have got the PCN, have you moved, is the v5c in your name at your address?

1) This is a Charge Certificate, Not a PCN.
2) Deadlines are now important. I you do nothing, the next stage (others will correct me if I am wrong) will be the issue of an Order for Recovery at which stage you can file a witness statement (others more knowledgeable me will explain more accurately)

However, we have noted that Dart can be reasonable.
So while you're waiting for others to chip in here, do look at the other threads here and the Facebook page and see if you can find some helpful pointers before contacting them

But do watch out for deadlines..

So, after lots of back and forth it looks like the receipt I had was for another crossing, so there was one crossing charge outstanding. However the Highways England chap said he would cancel the PCN as I didn't receive the £70 notice which is correct. He said I need to call Dart Charge customer services and there would be a note on my account to cancel the PCN and accept the £2.50 payment. However the customer services initially couldn't see the note, then I called again and they now see it but say they can't cancel the fine and her manager will email Highways England asking them to cancel it. So fingers crossed it will all go to plan and I won't receive a court order! I have asked for email confirmation but that will only happen once it is cancelled successfully.

Thanks to all for the advice on here, the Facebook posting on the Dart Charge page stating the situation objectively definitely seems to be a good option.

So that's half a day gone, now to get on with my work....!

Fair play to them.
Just keep an eye out that it is actually cancelled and if the original £2.50 outstanding, pay it.

Would that councils were as accommodating.

Yup, I have paid the £2.50 and my contact on FB is going to follow the cancellation through the system and let me know when it has completed. Pretty amazing. Nice to have a good story to tell.

When we see the ruthlessness, venality, and rapacity of council parking departments, it is good to see that in a small corner of England the traditional public service ethic is still alive ! Of course, one could also say that there must be a huge number of foreign vehicles crossing every day without paying and with no hope of the payment being obtained.
