just received NIP through post this morning.

1. The name of the Constabulary: North Wales Police
2. Date of the offence: 13/04/06
3. Date of the NIP: 21/04/06
4. Date you received the NIP: 28/04/06
5. Location of offence (exact location as it appears on the NIP: important): A548 Greenfield, Flintshire
6. Was the NIP addressed to you?: yes
7. Was the NIP sent by first class post, second class or recorded delivery?: first
8. Are you the Registered Keeper of the vehicle : yes
9. How many current points do you have? : 0
10. Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons.: cant remember anything of the incident. 2 possible drivers, have sent off letter asking for photo evidence. seems a bit harsh 35 in a 30. if photo links me to driving, do i just go the pace route or are there any other possibilities?

Is there a postmark on the envelope? There's a possibility that you were served this NIP outside the 14 day limit.

brother in law told me that they are twats for catching people out just above speed limit. apparently zero tolerance. we'll have to see how tolerant they are as i WILL NOT take it up the tradesmans entrance!!! they will have to work hard to get my well earned honest cash!

No postmark? How about a stamp? If they hand-delivered it it will be invalid.

That's the spirit! £60 is £60 to them, whether you were going 35 or 45. You are right, though, it is a little harsh.

why would they be obliged to prove that the NIP was sent within the timeframe? if that was the case, everyone would go down the route saying NIP was delivered late and outside the 14day ruling. they have no real proceedure to verify if the NIP was delivered within this time. whereas WE have to prove everything.

You received the letter outside the timeframe, and they do record the posting of them.

I agree it will probably come to nothing, but why not call them and ask them if they have a record of the day it was posted? I think that they do record the posting date of each NIP. If they only posted it on day 14 after the offence, the day by which it is supposed to be served, then it would be worth studying the exact law to see if it gives you a defence. I apologise if this work does not help - but you'll kick yourself later if you find that you missed a ready-made get-out-of-jail card.

so what happens if they posted it on the 21st but i didnt receive it until today? is it still classed as served even though royal mail is slow?

No. It is served when it is delivered.
However, it will be deemed to have been served a day or 2 after being posted, unless and until the contrary is proved. Basically, you have to prove (by giving credible evidence under oath) that it was not delivered until today.

Unless they have some proof that they posted it before the 27th (some Scameraships do record posting dates of individual NIPs), then you are probably home-free - because they need to post it in time to be served within 14 days. RAC letter should put an end to it. If they don't respond to RAC letter, then it would be prudent to respond to the NIP with a PACE letter within 28 days anyway.

spoke to scammers today, they have told me that the NIP was sent on the 21st April. thats a Friday so if they missed the post it would have been sent on the monday. i did not get it until friday, so it is feasible that i can apply for the 14 day rule. any ideas???

They've just read back to you the date on the NIP. I would call them back and ask if they actually have any proof that it was posted on that day.

spoke to scammers today, they informed me that the postman signs for the mail, this probably means that he signs for a batch of mail and not any particular one individualy. any comments??

i have sent RAC letter stating it was served out of the 14 day rule. i have also requested photo evidence but have yet to receive it. what are the likely outcomes?
